How is that possible?
If a creditor contacts a lawyer due to a debtor’s default, the creditor is legally entitled to reimbursement of reasonably incurred legal costs. These are paid by the debtor – not the client.
According to Czech Decree No. 177/1996 Coll. (Attorney Tariff), the debtor is required to cover at least two legal acts at the initial stage – typically the acceptance of representation and drafting a formal demand.
This is based on Section 142(1) of the Civil Procedure Code and Section 513 of the Civil Code.
